Recent Hearing examiner decision called for cutting forests of Oregon white oak and destroying habitat of Western Gray Squirrel, an endanger species.
Spanaway Group Files for Reconsideration of Tiny Home Village
The Spanaway Concerned Citizens group (SCC) decided to file for reconsideration in their quest to stop the permits for a village of 280 homes in a Priority Wildlife Area surrounding Audubon Springs. Their attorney, David Bricklin, one of the best in the state, advised them that challenging the vesting of the project was their strongest argument.
Filing for reconsideration, the SCC will ask the Hearing Examiner to review his own decision. In an email sent to donors and members, the SCC stated “while we do NOT have high hopes of the HEX reversing his own decision, this is one step in the process of possibly appealing his decision.” Reconsideration buys the appellants time and lays the groundwork for a possible appeal.
The previous hearing examiner has quit county employment which will further delay the request for Once reconsideration by SCC. There will be further delay while the new examiner reviews the findings and write a response. Next stops in the appeal process include an appeal in either the Superior Court or the state Court of Appeals.

In a previous email, the SCC asked members and donors for feedback on where supporters stand on continuing the fight. They asked if people are “mad as heck.” The responses were mixed, but the majority still want to keep fighting to Stop The Village. Here’s a sample of what people had to say:
“I have followed your fight from the beginning and have contributed to the cause. I am in total support of furthering the efforts to stop this village from becoming a reality and will continue to send donations as needed. I thank all of you for all of the hard work you have done and know that there are many of us who will walk beside you in this continuing effort.”
According to the email, all of their legal fees are paid up through the month of May. Filing for reconsideration will cost between $5,000 and $10,000. “We are counting on everyone who opposes this Village to help us get through this next phase of the fight. We all have so much to lose if this Village is built.”
“The SCC team has been working every day since the HEX decision was announced on June 3rd. We are tired, but we are still in it to win it. Maybe we will get a little breather while we wait for the reconsideration decision, but we need to keep fundraising to pay the attorneys for their work on the reconsideration!”
